Gary E. Proctor

Gary Proctor is an attorney based in Baltimore, Maryland. He focuses his practice in criminal defense and has many years of experience working on capital cases. He has been recognized as a Super Lawyer for the past five years.

Mr. Proctor began his legal career in Louisiana, working with the Louisiana Capital Assistance Center, providing defense, investigation and mitigation in death penalty cases both in Louisiana and throughout the southern United States. While there he worked on several high profile capital cases, as well as litigation to challenge cruel and unusual conditions on Mississippi’s death row, which resulted in the favorable decision of Gates v. Cook, 376 F.3d 323 (5th Cir. 2004). He was certified by the statewide indigent defender board in 2003 to represent persons charged with capital offenses.

Mr. Proctor continued his work in Baltimore after starting his own practice in 2005. He has successfully continued his capital work in Maryland. He has helped clients avoid the death penalty at trial in both state court, prior to Maryland’s abolition of the death penalty, and in Maryland federal court (United States v. James Dinkins). He has appeared as learned counsel in around 30 death eligible cases in the U.S. District Courts in Maryland, District of Columbia, Puerto Rico, the Northern District of West Virginia, and the Eastern District of Kentucky.

In addition to his capital experience, Mr. Proctor represents clients facing federal felony charges and serious felonies in state court.

Jennifer Smith

Jennifer Smith is an associate attorney at The Law Offices of Gary E. Proctor, LLC. She handles a variety of cases, including state and federal criminal defense. Jennifer joined the firm as a law clerk in 2017, after having served as a law clerk at the Federal Defender’s office in Baltimore, Maryland. 

Jennifer graduated with honors from the University of Maryland Francis King Carey School of Law in 2018. She was active in the public interest law community and served on the board of the Maryland Public Interest Law Project, Inc. Jennifer also represented community groups seeking equitable housing opportunities as a student attorney in the school’s Community Equity and Development clinic.

Jennifer is a lifelong resident of Baltimore City.
