Capital Criminal Defense

There is no criminal matter more serious than a prosecution in which the Government seeks the imposition of the death penalty. Mr. Proctor has nearly twenty years of experience fighting for the rights of clients facing the death penalty and currently serves as learned counsel on a number of cases throughout the United States. Mr. Proctor has worked on state cases in Texas, Louisiana, Georgia, Maryland, and Idaho.  Mr. Proctor has worked on federal cases in the Districts of Maryland, West Virginia, Kentucky, the District of Columbia, the Eastern District of Pennsylvania, Puerto Rico, and the U.S. Virgin Islands.

Prior to the abolition of the death penalty in Maryland in 2013, Mr. Proctor represented multiple individuals facing the death penalty in Maryland at the trial level and in post-conviction proceedings. While the death penalty has been abolished in Maryland, the federal government may still pursue the death penalty against individuals. Mr. Proctor has prevented and continues to successfully prevent the imposition of the death penalty in an array of federal cases.

Post Conviction

Post-conviction is one of the most difficult areas of criminal law, but also one of the most important. Post-conviction allows people to challenge their convictions on many fronts not available on appeal such as ineffective assistance of counsel, prosecutorial misconduct, and the imposition of an illegal sentence. For many, post-conviction proceedings are the last chance they have to challenge their conviction or sentence.

The Law Offices of Gary Proctor has successfully represented clients in Maryland post-conviction proceedings, in Maryland coram nobis proceedings, and in federal § 2255 proceedings in the United States District Court in Maryland and Washington, D.C. Mr. Proctor has won both resentencings and vacations of convictions in these proceedings.

In addition to traditional criminal post-conviction proceedings, Mr. Proctor has experience handling capital post-conviction proceedings. Mr. Proctor represented three persons on Maryland’s death row in post-conviction proceedings and, as such, is very skilled in representing persons, when all other appeals have failed.  These representations terminated when Governor O’Malley commuted their sentences.
